A sentence of seven years' imprisonment for cultivating a commercial quantity of cannabis (400 plants, projected yield 25.6 kg, wholesale value $100,000-$200,000) was manifestly excessive; a sentence of three years and three months was substituted. Cannabis cultivation is not to be equated with heroin dealing for sentencing purposes, as different drugs cause harm in different ways and degrees. A sentencing judge should not take into account the likelihood of future offending in fixing the quantum of sentence.
