The 'blameworthiness' or 'complicity' of a victim of culpable driving causing death is not a mitigating or aggravating factor in sentencing. The victim's conduct is relevant only insofar as it bears on the quality of the offender's driving or slightly mitigates the offender's decision to drive (e.g., where a reluctant motorist is importuned by passengers). Youth is ordinarily of much reduced significance as a mitigating factor for culpable driving given the seriousness of the offence and the importance of general deterrence.
