The majority upheld a wholly suspended sentence for aggravated burglary and rape where the combination of early guilty plea, genuine remorse, full admissions, good rehabilitation prospects, unlikelihood of reoffending, absence of relevant prior convictions, and absence of force beyond that inherent in the offending was held capable of constituting exceptional circumstances justifying departure from the general principle that rape warrants immediate imprisonment. The dissent would have held these factors insufficient. The case confirms that appellate restraint applies with particular force in Director's appeals where the offender has been released into the community.
