Offences committed at Commonwealth places such as airports are Commonwealth offences by operation of s 4(1) of the Commonwealth Places (Application of Laws) Act 1970 (Cth), which picks up State laws and applies them as Commonwealth laws. State police have jurisdiction to arrest at Commonwealth places and State courts exercise federal jurisdiction when trying such offences, even where neither prosecution nor defence adverts to the federal character of the proceedings. The failure to recognise the character of proceedings as Commonwealth proceedings does not change that character.
