A plea of guilty and its timing do not bear upon the assessment of objective seriousness of an offence for the purpose of the standard non-parole period regime. Where a s.112(2) offence is motivated by retribution rather than personal gain, involves no disguise, the offenders are known to the victim, and there is an element of provocation, the offence is likely to fall below the mid-range of objective seriousness. A sentence for a s.195(a) offence that approaches or exceeds the maximum penalty after allowing for a guilty plea discount will be manifestly excessive where the offence is far removed from the worst type of case.
