A community-based order for intentionally causing serious injury (glassing) is not necessarily manifestly inadequate where the offender is a young first offender with a chaotic background, self-motivated rehabilitation, and sound rehabilitation prospects, even where the offence involved unprovoked and vicious conduct causing permanent injury. However, such circumstances are exceptional and in the ordinary course a custodial sentence would be expected for such offending.
