The fact that a worker was not performing positive employment duties but was in an interval between duties when injured is relevant to, but not determinative of, whether employment was a substantial contributing factor under s 9A of the Workers Compensation Act 1987 (NSW). A decision-maker who treats this as a matter of considerable significance, while having regard to all relevant factual findings, does not commit an error of law.
