An uplift of 2 years to a head sentence for relatively minor Form 1 matters (including a goods in custody charge with a 6-month maximum and small drug quantities) is outside the appropriate range, given the lower salience Form 1 matters must have in the sentencing process. However, a sentencing appeal will be dismissed where the applicant has received a countervailing benefit from wholly subsumed concurrent sentences for serious offences, such that a less severe sentence is not warranted in law. Multiple serious drug supply counts should each receive a distinct sentence rather than being wholly subsumed within a single sentence.
