A sentencing judge's error in stating the wrong maximum penalty is a relevant error but does not automatically result in the sentence being set aside on Crown appeal if the sentence, though lenient, remains within the appropriate range. The standard non-parole period does not render consideration of the correct maximum penalty irrelevant. A failure to expressly mention general deterrence does not of itself constitute error.
