The parity principle does not require adjustment of a juvenile offender's sentence where the difference in sentences is explained by material differences in age, criminal history, and circumstances of offending between co-offenders. Where a sentencing judge fails to expressly address the discretion to record convictions against a child under s 184(1) of the Youth Justice Act 1992 (Qld), the appellate court will exercise the discretion afresh but may reach the same result.
