Pre-offence conduct that could constitute a separate lesser offence (such as stalking) may properly be taken into account as part of the circumstances surrounding the charged offence, provided there is no element of double punishment. In sentencing for rape, a sentencing judge must give adequate weight to youth, emotional immaturity and rehabilitation prospects even where the offending is serious and purposeful.
