A pretext telephone call arranged by police, in which the complainant confronts the accused with allegations and the accused responds in a manner consistent with consciousness of guilt (angry/defensive tone, failure to express surprise, statements such as 'don't go there' and 'anybody would who done things like that'), is admissible evidence capable of demonstrating consciousness of guilt and may be left to the jury. Where no application to exclude evidence on discretionary grounds is made at trial, there is no error in law on that basis.
