For dangerous operation of a motor vehicle causing death and grievous bodily harm where the offending involves inattention that is more than momentary but not prolonged, and does not involve alcohol, drugs, speed or fatigue, a head sentence of around three and a half years imprisonment is at the upper end of the appropriate range. A head sentence of five years imprisonment is manifestly excessive in such circumstances. The head sentence must itself be within the appropriate range and cannot be justified merely because the period of actual custody under a suspended sentence is moderate.
