A 21-year-old offender who retrieves, loads and fires a weapon in a series of deliberate steps engages in adult-type offending notwithstanding youth, and the sentencing principles applicable to young offenders (reduced emphasis on deterrence, greater emphasis on rehabilitation) do not apply where there is no nexus between immaturity and the offending. The case also illustrates that continued drug use in custody will result in prospects of rehabilitation being assessed as guarded at best. On re-sentencing methodology after Muldrock error, the majority endorsed comparison of the independently determined sentence with the original sentence at the end of the process, while Simpson J maintained the original sentence should play no role in selecting the re-determined sentence.
