When sentencing for a standard non-parole period offence using aggregate sentencing, the sentencing judge must fix an indicative non-parole period for that offence under s 54B(4) of the Crimes (Sentencing Procedure) Act 1999, even though failure to do so does not invalidate the sentence under s 54B(7). Sentencing judges must expressly assess objective seriousness and indicate how Form 1 offences are taken into account, particularly in complex multi-count cases. It is inappropriate to place offences against a different victim on a Form 1 schedule, especially where those offences carry standard non-parole periods but the principal offence does not.
