A party to a settlement deed who is not the former client of a legal practitioner cannot invoke the court's equitable jurisdiction to protect the former client's confidential information unless the settlement deed expressly transfers those rights. A clause permitting a party to 'do all acts required or necessary for the purpose of defending or enforcing rights' does not transfer the former client's equitable rights, including the obligation of confidence owed by a legal practitioner. A 'further action' clause requiring parties to use reasonable efforts to give full effect to a deed is not a source of additional rights beyond those conferred by the deed.
