Where the prosecution case is overwhelmingly strong within the meaning of s 35(4) of the Crimes (Sentencing) Act 2005 (ACT), no significant reduction in sentence may be made for a guilty plea; the threshold is that an acquittal is realistically unlikely, assessed practically. Voluntary surrender to police and cooperation with forensic procedures constitute 'assistance in investigating' an offence under s 36, entitling an offender to a small discount even where arrest was otherwise likely. A non-parole period for a serious offence requires adequate reasons, particularly where the only justification is rehabilitation but no assessment of realistic rehabilitation prospects has been made.
