Architects Act 2004

After investigating a complaint against an architect, the architects board must—

if the board is satisfied that a ground for occupational discipline exists in relation to the complaint—

apply to the ACAT for occupational discipline in relation to the architect; and

tell the complainant in writing that the application has been made; or

if the board is not satisfied that a ground for occupational discipline exists in relation to the complaint—

tell the complainant in writing that the board will take no further action on the complaint; and

take no further action on the complaint.

Subsection (1) (b) (ii) does not prevent the architects board from taking further action in relation to a complaint if the board becomes satisfied that a ground for occupational discipline exists in relation to the complaint.

The registrar need not notify the complainant under s (1) if the complainant has withdrawn the complaint (see s 36).
