120 Disclosure of information by ART providers and others
(1)
A requirement to disclose information under this Act has effect despite any duty of confidentiality or other restriction on disclosure (including under the Health Records (Privacy and Access) Act 1997).
(2)
If a person discloses information in accordance with this Act—
(a)
the disclosure is not—
(i)
a breach of confidence; or
(ii)
a breach of professional etiquette or ethics; or
(iii)
a breach of a rule of professional conduct; and
(b)
the person does not incur civil or criminal liability only because of the disclosure.
