121 Protection of public officials from liability
A public official is not civilly liable for conduct engaged in honestly and without recklessness—
in the exercise of a function under this Act or another territory law; or
in the reasonable belief that the conduct was in the exercise of a function under this Act or another territory law.
Any liability that would, apart from this section, attach to the public official attaches instead to the Territory.
In this section:
public official—
means—
the director-general; or
an authorised person; or
a person exercising a function under this Act; but
does not include an ART provider.
