The director‑general need not give notice under section 103 before suspending a person’s registration—

if the director‑general is satisfied that the suspension is required urgently because of the biosecurity impact of the regulated dealing being carried out by the registered person; or

in an emergency; or

for any other reason prescribed by regulation.

However, if the director‑general suspends a person’s registration without giving prior notice, the director‑general must give the person a written notice stating—

the grounds for the suspension; and

that the person may, by a stated day that is at least 14 days after the day the notice is given to the person, make a submission to the director‑general about the suspension.

If the person makes a submission before the stated day, the director‑general must—

consider the submission; and

decide whether to revoke or continue the suspension; and

give the person written notice of the decision.
