86 Surrender of licences
A person commits an offence if—
the person’s licence has been suspended or cancelled; and
the person does not surrender the licence to the registrar within 2 weeks after the day of suspension or cancellation.
Maximum penalty: 5 penalty units.
Each partner commits an offence if—
the partnership’s licence has been suspended or cancelled; and
the licence is not surrendered to the registrar within 2 weeks after the day of suspension or cancellation.
Maximum penalty: 5 penalty units.
It is a defence to a prosecution for an offence against subsection (1) or (2) if the defendant proves that the licence has been destroyed, lost or stolen.
It is a defence to a prosecution for an offence against subsection (2) if the partner proves that—
the partner did not know about the contravention of the subsection involved in the offence; and
either—
the partner took reasonable precautions and exercised appropriate diligence to avoid the contravention; or
the partner was not in a position to influence the partnership in relation to the conduct involved in the contravention.
