87 Breach of licence conditions or codes
A licensee commits an offence if the licensee contravenes a condition of the licence.
Maximum penalty: 50 penalty units.
Each partner in a partnership commits an offence if—
the partnership is a licensee; and
the licensee contravenes a condition of the licence.
A person who is a licensee commits an offence if the person contravenes a code of practice applicable to the person.
Maximum penalty: 50 penalty units.
Each partner in a partnership commits an offence if the partnership—
is a licensee; and
contravenes a code of practice applicable to the licensee.
Maximum penalty: 50 penalty units.
It is a defence to a prosecution for an offence against subsection (2) or (4) if the partner proves that—
the partner did not know about the contravention of the subsection involved in the offence; and
either—
the partner took reasonable precautions and exercised appropriate diligence to avoid the contravention; or
the partner was not in a position to influence the partnership in relation to the conduct involved in the contravention.
An offence against this section is a strict liability offence.
In this section:
code of practice means a code of practice under this Act or an operational Act.
