Crimes Act 1900

If—

a police officer has reason to believe that an offence has been or may have been committed; and

believes on reasonable grounds that a person may be able to assist him or her in inquiries in relation to that offence; and

the name or address (or both) of that person is unknown to the officer;

may request the person to provide his or her name or address (or both) to the officer; and

if making such a request—shall inform the person of the reason for the request.

If a police officer—

makes a request of a person under subsection (1); and

informs the person of the reason for the request; and

complies with subsection (3) if the person makes a request under that subsection;

fail to comply with the request; or

give a name or address that is false in a material particular.

If a police officer who makes a request of a person under subsection (1) is requested by the person to provide to the person—

his or her name or the address of his or her place of duty; or

his or her name and that address; or

if he or she is not in uniform and it is practicable for the police officer to provide the evidence—evidence that he or she is a police officer;

fail to comply with the request; or

give a name or address that is false in a material particular.

As soon as possible after making such a request, the police officer shall make a written record of the grounds for his or her belief.
