Criminal Code 2002

A person commits an offence if—

the person dishonestly—

provides a benefit to an agent or someone else; or

causes a benefit to be provided to an agent or someone else; or

offers to provide, or promises to provide, a benefit to an agent or someone else; or

causes an offer of the provision of a benefit, or a promise of the provision of a benefit, to be made to an agent or someone else; and

the person does so with the intention that the agent will provide a favour.

Maximum penalty: 1 000 penalty units, imprisonment for 10 years or both.

An agent commits an offence if—

the agent dishonestly—

asks for a benefit for the agent or someone else; or

obtains a benefit for the agent or someone else; or

agrees to obtain a benefit for the agent or someone else; and

the agent does so with the intention—

that the agent will provide a favour; or

of inducing, fostering or sustaining a belief that the agent will provide a favour.

Maximum penalty: 1 000 penalty units, imprisonment for 10 years or both.
