378 Unlawful possession offence—return of or compensation for forfeited property
If, after the end of the 90-day period mentioned in section 376 (1) (b), the owner of the property claims the property, the public trustee and guardian must, if satisfied that the person is the owner—
if the property is money—pay the money to the person; or
in any other case—return the property to the person or pay the person reasonable compensation for the property.
This section does not apply if the property is subject to forfeiture, or has been forfeited, under the Confiscation of Criminal Assets Act 2003.
Note The Confiscation of Criminal Assets Act 2003 provides for compensation or the return of forfeited property in certain circumstances.
