75 Taking fish contrary to licence
(1)
The holder of a fisheries licence commits an offence if—
(a)
the licence holder takes a fish; and
(b)
the fisheries licence does not permit the holder to take the fish.
Maximum penalty: 10 penalty units.
(2)
Subsection (1) does not apply if—
(a)
the licence holder unintentionally takes the fish; and
(b)
the licence holder immediately returns the fish to the waters from which it was taken with the least possible injury.
