76 Importing or exporting live fish without authority

(1)

A person commits an offence if—

(a)

the person imports a live fish into, or exports a live fish from, the ACT; and

(b)

the person does not—

(i)

hold a licence authorising the import or export; or

(ii)

have the conservator’s written approval for the import or export.

Maximum penalty: 100 penalty units, imprisonment for 1 year or both.

(2)

A person commits an offence if—

(a)

the person is the holder of a licence authorising the import of live fish into, or the export of live fish from, the ACT; and

(b)

the person imports a live fish into, or exports a live fish from, the ACT; and

(c)

the import or export is not authorised by the licence.

Maximum penalty: 50 penalty units.

(3)

This section does not apply to—

(a)

fish bought from a registered fish dealer for human consumption; or

(b)

fish of an exempt species; or

(c)

a person if the person’s conduct is exempt conduct.

(4)

An offence against subsection (2) is a strict liability offence.
