85 Use of fishing gear generally

(1)

A person commits an offence if—

(a)

the person uses fishing gear to take fish from public waters; and

(b)

any of the following applies:

(i)

the person is not within 10m of the gear;

(ii)

the person cannot see the gear at all times;

(iii)

the person is not permitted to take fish under this Act from waters using the fishing gear.

Maximum penalty: 50 penalty units.

(2)

An offence against this section is a strict liability offence.
