86 Non-permitted fishing gear
(1)
A person commits an offence if—
(a)
the person uses fishing gear in or beside public waters; and
(b)
the use of the fishing gear is not permitted by a declaration under section 17 (Declaration of fishing gear).
Maximum penalty: 50 penalty units.
(2)
A person commits an offence if—
(a)
the person is—
(i)
in or beside public waters; and
(ii)
in possession of fishing gear; and
(b)
the use of the fishing gear is not permitted by a declaration under section 17.
Maximum penalty: 30 penalty units.
(3)
An offence against this section is a strict liability offence.
(4)
This section does not apply if the person’s conduct is exempt conduct.
