86A Offence—use prohibited gear
(1)
A person commits an offence if—
(a)
the person uses fishing gear in waters; and
(b)
the gear is prohibited fishing gear.
Maximum penalty: 100 penalty units.
(2)
A person commits an offence if—
(a)
the person is—
(i)
in or beside waters; and
(ii)
in possession of fishing gear; and
(b)
the gear is prohibited fishing gear.
Maximum penalty: 50 penalty units.
(3)
An offence against subsection (2) is a strict liability offence.
(4)
This section does not apply if the person’s conduct is exempt conduct.
