Search warrant
24 Search warrant
If a magistrate is satisfied, on the application of the chief executive officer supported by an affidavit or other sworn evidence, that there is a reasonable ground for suspecting that a document or gaming equipment relevant to an investigation into a possible offence against a gaming law, or any other thing constituting evidence of an offence against a gaming law, may be found in certain premises, the magistrate may issue a warrant authorising an authorised officer together with any assistants named or described in the warrant—
to enter those premises, using the force that is necessary for the purpose; and
to search the premises and to break open and search anything in the premises in which a document or any gaming equipment may be stored or concealed; and
to seize and remove, on behalf of the commission—
any document that appears to be relevant to the obligations of a person under a gaming law; or
any gaming equipment that the officer believes on reasonable grounds to be connected with an offence against a gaming law; or
any other thing that the officer believes on reasonable grounds might be used as evidence in a prosecution for an offence against a gaming law.
The powers given by this section are in addition to, and not in derogation of, any other powers given by law.
