Injunctions to restrain dealings
72 Injunctions to restrain dealings
The ACAT may, on application, by order, restrain a person from entering into, completing or registering or otherwise giving effect to a transaction with someone else in relation to the property of the other person if satisfied that there are grounds for the appointment of a manager for the property.
An order remains in force for the period, not longer than 3 days, that is specified in the order but if, within the period, an application for the appointment of a manager is made to the ACAT, the ACAT may, by order, continue the first order until the application is decided.
A person who has notice of an order under this section must not act contrary to the order.
Maximum penalty (subsection (3)): 50 penalty units, imprisonment for 6 months or both.
