Independent Competition and Regulatory Commission Act 1997

A civil penalty notice must state the following:

the date it is served;

the name and address of the person served with the notice;

that the person is alleged to have engaged in conduct that constitutes a contravention of a stated civil penalty provision;

a brief description of the alleged contravention, including when and where it is alleged to have occurred;

the amount payable under the notice for the alleged contravention;

how the person may pay the amount;

the time for payment of the amount (being within 28 days or a stated longer period);

that if the person pays the amount within the time for payment, unless the notice is withdrawn under section 54J—

the commission will not start an enforcement order proceeding against the person in relation to the alleged contravention; and

the person will not be prosecuted for a corresponding offence;

that if the person fails to pay the amount within the time for payment, or the notice is withdrawn under section 54J—

the commission may start an enforcement order proceeding against the person in relation to the alleged contravention; or

the person may be prosecuted for a corresponding offence;

anything else prescribed by regulation.
