40 Decision under this division binding
(1)
This section applies to a decision by—
(a)
an eligibility assessment panel about whether an injury satisfies the criteria stated in the LTCS guidelines for eligibility for participation in the LTCS scheme; or
(b)
if the eligibility assessment panel’s decision is reviewed under section 39—an eligibility review panel about whether an injury satisfies the criteria stated in the LTCS guidelines for eligibility for participation in the LTCS scheme.
Note The LTCS guidelines are made under s 93.
(2)
The decision is final and binding for this Act and any court proceeding under this Act.
