248 Damages for compensation paid under workers compensation scheme
(1)
This section applies if a claimant—
(a)
receives compensation under a workers compensation scheme in relation to a person’s injuries or death; and
(b)
is awarded damages in a motor accident claim in relation to the person’s injuries or death; and
(c)
because of the award of damages, is liable to repay the compensation received.
(2)
The award of damages must include damages equal to the amount of compensation received by the person under the workers compensation scheme.
