Division 7.3.1Applications for prohibited development—general
154 Meaning of prohibited development
(1)
For this Act, a development is a prohibited development if either of the following applies to the development or a part of the development:
(a)
the development is prohibited under the territory plan;
(b)
for a development that is in a future urban area—
(i)
the development is undertaken by an entity other than the Territory or a territory authority; and
(ii)
the territory plan states that the development is not prohibited.
(2)
However, if a development is an exempt development and a prohibited development, the development is taken not to be a prohibited development.
