252 Offset management plan—amendment initiated by decision‑maker
The decision‑maker may, by written notice (an amendment notice) given to the offset manager for an offset management plan, amend the offset management plan if satisfied that—
the offset for the amended offset management plan is at least equivalent to the offset for the original offset management plan; and
the offset for the amended offset management plan is consistent with the offsets policy.
However, the decision‑maker may amend the offset management plan only if—
the decision‑maker has given the offset manager for the offset management plan written notice of the proposed amendment (a proposal notice); and
the proposal notice states that written submissions about the proposal may be made to the decision‑maker before the end of a stated period of at least 14 days after the day the proposal notice is given to the offset manager; and
after the end of the stated period, the decision‑maker has considered any submissions made in accordance with the proposal notice.
The amendment takes effect on the day the amendment notice is given to the offset manager for the offset management plan or a later day stated in the amendment notice.
