Proponent initiated amendment—acceptance of application
59 Proponent initiated amendment—acceptance of application
If the territory planning authority accepts an application for a proponent‑initiated amendment under section 57, it must publish the following on the authority website when the draft amendment is published under section 63 (1) (Public consultation—notification and availability of draft major plan amendments etc):
the decision to accept the application;
the application;
any additional information, and the request for that information, mentioned in section 58 (3).
After accepting the application, the territory planning authority must prepare a document to amend the territory plan (a draft major plan amendment).
However, the territory planning authority—
is not taken to support the application by preparing the draft major plan amendment; and
must continue to assess the merits of the application; and
is not bound to proceed with the amendment.
