107 Unauthorised assertions

(1)

A person must not make an assertion to a contact of a third person that the third person has a transmissible notifiable condition without the consent of the third person, unless authorised to do so under this Act.

Maximum penalty: 50 penalty units, imprisonment for 6 months or both.

(2)

This section applies in relation to a person asserted to have a transmissible notifiable condition irrespective of the truth of the assertion.

(3)

In this section:

contact, in relation to a person asserted to have a transmissible notifiable condition, means a person who would be a contact of the other person if the other person had that condition.
