Dealing with unregistered radiation source

In force

(1)

A person commits an offence if—

(a)

the person owns a regulated radiation source; and

(b)

the regulated radiation source is not registered under section 26; and

(c)

another person deals with the unregistered radiation source; and

(d)

the dealing by the other person is not authorised under the other person’s licence in relation to the unregistered radiation source.

Maximum penalty: 100 penalty units.

(2)

It is a defence to a prosecution for an offence against this section if the defendant proves that the defendant took reasonable steps to prevent the unregistered radiation source from being dealt with by a person not authorised under a licence to deal with the radiation source.

Note

The defendant has a legal burden in relation to the matters mentioned in s (2) (see Criminal Code, s 59).
