Application for order appointing administrator
125 Application for order appointing administrator
The director-general may apply to the Supreme Court for an order appointing a stated person as an administrator in relation to the operator of a retirement village—
to exercise all the functions of the operator; or
to exercise stated functions of the operator; or
to exercise all the functions other than stated functions of the operator.
The director-general may apply for an order only if—
the director-general reasonably believes that the wellbeing or financial security of the residents of the retirement village has been, or is likely to be, seriously affected by the continued operation of the retirement village by the operator; or
the director-general reasonably believes that the operator is wilfully and repeatedly acting in contravention of an order made by the ACAT or a court in relation to the retirement village; or
the retirement village is the subject of an existing order under this section.
For the purpose of determining whether an application for an order should be made, the director-general may appoint a person to inquire into, and report to the director-general on, the wellbeing and financial security of the residents of the retirement village.
More than 1 order may be made under this division in relation to the same retirement village.
