Renovations and alteration of fixtures or fittings
63 Renovations and alteration of fixtures or fittings
A resident of a retirement village may, with the written consent of the operator of the village—
add, remove or alter a fixture or fitting on or within the resident’s residential premises; or
renovate the resident’s residential premises.
The operator may make the consent subject to reasonable conditions.
Without limiting subsection (2), the operator may make the consent subject to the condition that, on the ending of the resident’s village contract, the premises will be returned to the same condition as they were in immediately before the consent was given.
The operator must not unreasonably withhold consent to an addition, removal or alteration of a fixture or fitting, or to a renovation, mentioned in subsection (1).
Despite subsection (1), the consent of the operator is not required—
to remove or alter a fixture or fitting that was added by a resident, unless the removal or alteration of the fixture or fitting is likely to cause significant damage to the residential premises; or
to renovate, or to add, remove or alter a fixture or fitting, prescribed by regulation.
