Surveyors Act 2007

This section applies if the surveyor-general believes on reasonable grounds that—

a surveyor has become mentally or physically incapacitated; and

the incapacity substantially affects the surveyor’s ability to practise surveying.

The surveyor-general may cancel the surveyor’s registration.

However, the surveyor-general must not cancel the surveyor’s registration unless—

the surveyor-general—

gives the surveyor written notice under section 24 of the surveyor-general’s intention to cancel the registration; and

takes into consideration any response received from the surveyor in accordance with the notice; and

the surveyor-general is satisfied that—

the surveyor is mentally or physically incapacitated; and

the incapacity substantially affects the surveyor’s ability to practise surveying; and

at least 15 business days have passed since the day the notice was given under section 24.

Cancellation of a person’s registration under this section takes effect—

when written notice of the cancellation is given to the person; or

if the written notice of the cancellation states a later date—on the stated date.
