74 Restricted information—Aboriginal cultural trees
(1)
Information about the location or nature of an Aboriginal cultural tree is restricted information unless the conservator declares in writing that it is not.
(2)
Before making a declaration under subsection (1), the conservator must ask each representative Aboriginal organisation for advice in relation to the proposed declaration.
(3)
The conservator must take reasonable steps to give a copy of the declaration to the following:
(a)
the person who nominated the tree for registration;
(b)
the lessee or occupier of, or custodian for, the land where the tree is located;
(c)
the heritage council;
(d)
each representative Aboriginal organisation.
