77 Limited access to restricted information—land for sale
This section applies if—
land is offered for sale; and
an Aboriginal cultural tree is located on the land; and
there is restricted information about the tree; and
an interested person for the land applies to the conservator for access to any restricted information about the tree that relates to the conservation and use of the land.
The conservator may give the applicant—
the restricted information sought; and
a written explanation about the operation of this part.
The conservator must ask each representative Aboriginal organisation for advice in relation to the proposed disclosure before giving the applicant the restricted information.
In this section:
interested person—each of the following is an interested person for land where an Aboriginal cultural tree is located:
someone considering buying an interest in the land;
the person who nominated the tree for registration;
the lessee of, or custodian for, the land where the tree is located;
the heritage council;
each representative Aboriginal organisation.
