76 Approval to disclose restricted information

(1)

A person may apply, in writing, to the conservator for approval to disclose restricted information about an Aboriginal cultural tree to another person.

(2)

An application must—

(a)

identify the restricted information proposed to be disclosed; and

(b)

state the reason for the disclosure; and

(c)

state the nature of the disclosure, including the person to whom it would be disclosed.

(3)

The conservator may, by written notice given to the applicant, approve the disclosure of restricted information about the tree if satisfied that the disclosure will not have a substantial adverse effect on the values for which the tree is or may be registered.

(4)

Before approving the disclosure of restricted information about an Aboriginal cultural tree, the conservator must ask the following for advice in relation to the proposed disclosure:

(a)

each representative Aboriginal organisation;

(b)

the heritage council.
