170E Claim for payment if employer to pay and liability not covered by compulsory insurance policy etc
This section applies if—
a person has made a claim against an employer for compensation under this Act; and
the employer is not a licensed self-insurer; and
either—
the employer has agreed to pay compensation; or
the liability of the employer to pay compensation has been established; and
the liability of the employer to pay the compensation is not covered by a compulsory insurance policy; and
at the end of 1 month after the day the compensation becomes payable, the compensation (or any part of it) has not been paid to the person.
The person is eligible to make a claim for payment against the DI fund for payment of the amount of the compensation that remains unpaid.
In this section:
compensation includes—
an amount in settlement of a claim for compensation; and
costs payable to a worker by an employer in relation to a claim for compensation.
