Claim for payment if entitlement to claim compensation and licensed self‑insurer unable to pay compensation

In force

(1)

This section applies if—

(a)

a person has made a claim against an employer for compensation in relation to a territory worker employed by the employer; and

(b)

the employer is a licensed self-insurer; and

(c)

either—

(i)

the employer has agreed to pay compensation; or

(ii)

the liability of the employer to pay compensation has been established; and

(d)

the employer is unable to pay the amount of compensation.

(2)

The person is eligible to make a claim for payment against the DI fund for payment of the amount of compensation.
