283 Fees for delivery of funded aged care services—short‑term residential care
A registered provider delivering short‑term funded aged care services through the service group residential care to an individual on a day may charge the individual an amount (the resident respite fee) for or in connection with those services.
Subject to section 284, the resident respite fee charged to the individual for the day must not exceed the sum of:
whichever of the following is applicable:
the amount prescribed by, or worked out in accordance with, the rules;
if no rules are in force for the purposes of subparagraph (i)—the amount obtained by rounding down to the nearest cent the amount equal to 85% of the basic age pension amount (worked out on a per day basis); and
such other amounts as are prescribed by, or worked out in accordance with, the rules.
If the registered provider does not, or is taken not to, deliver funded aged care services to the individual on the day, the registered provider must not charge the individual a resident respite fee under subsection (1) for the day.
The registered provider may, in accordance with the rules, charge the individual a booking fee for or in connection with the delivery of the funded aged care services mentioned in subsection (1).
Without limiting paragraph (2)(b), rules made for the purposes of that paragraph may provide that an amount may be charged for only a particular period.
